How Ticket Resale Is Regulated In New York
New York regulates the resale market rather than banning it. The rules are about disclosure, licensing and what software may do.

New York permits the resale of event tickets above face value, and regulates how that market operates. The rules sit in the Arts and Cultural Affairs Law and are enforced by state authorities.
Licensing
Ticket resellers operating in New York are generally required to be licensed and to maintain a bond. The bond exists so that a consumer who is defrauded has something to claim against, which is the practical purpose of the whole licensing regime.
Disclosure
The law imposes disclosure requirements on resale platforms and sellers: whether the seller is a reseller rather than the original issuer, and clarity about the total price a buyer will pay including fees.
Fee disclosure has been a persistent point of enforcement, because a headline price that grows substantially at checkout is the most common complaint in this market. Requirements around presenting all-in pricing have tightened over time.
Speculative tickets
Selling a ticket you do not yet possess — a speculative listing — has been a specific focus of New York regulation, because a consumer can pay for a seat that the seller must then acquire, and may not.
Bots
Using software to circumvent the security measures or purchasing limits on a ticketing site is prohibited under New York law, and separately under federal law for tickets to public events. Penalties attach both to using such software and to knowingly reselling tickets obtained with it.
What this means for a buyer
Buy from a licensed reseller or an established platform with a guarantee. Before paying, confirm the all-in price, whether the ticket exists now or is speculative, and what happens if the event is postponed rather than cancelled — which is where most disputes actually arise.
The rules in this area are amended regularly. Confirm the current position with the New York State Attorney General's office before relying on any summary, including this one.
