What A Recording Contract Actually Says
An advance is a loan against your own royalties. Everything else follows from that.

Recording agreements vary enormously, but the structural elements are consistent and the most misunderstood is the first one.
The advance is recoupable
An advance is not a payment. It is money advanced against future royalties, recovered by the label from the artist's royalty share before the artist receives anything further.
An artist whose record does not generate royalties exceeding the advance is generally not required to repay the difference in cash — but they see no further income from that record. This is why artists with successful releases can remain unrecouped for years.
What else is recoupable
Recording costs are typically recoupable. So, frequently in part, are video production, tour support and independent promotion.
The list of recoupable costs is one of the most consequential provisions in the agreement and one of the least examined at signing.
Ownership of masters
In a traditional deal the label owns the sound recordings, often for the full copyright term. Alternatives exist — license deals where rights revert after a period, and distribution deals where the artist retains ownership and pays a distribution fee.
Ownership determines who controls future exploitation and who benefits from a catalogue's long-term value. It is the term that matters most over a career.
Options and terms
Agreements are frequently structured as an initial commitment with a series of options exercisable by the label. The artist is committed for the full potential run; the label decides at each stage whether to continue.
The scope of the deal
Some agreements extend beyond recordings into touring, merchandise, publishing and endorsements. These are more common than they were, and they should be priced accordingly rather than accepted as standard.
The practical advice
Engage a lawyer who specializes in music, paid by you rather than referred by the other side. The cost is small relative to the term of the agreement, and these contracts are long, technical and drafted by the party with more experience of them.
